The website charter-toscana.com is an online platform dedicated to searching for and booking recreational boats.

2. Role of charter toscana

charter toscana operates exclusively as a commercial intermediary between the Customer and the Owning Company. AZWEBITALIA S.a.s does not own the boats, is not a lessor and does not organize package tours.

The service offered consists exclusively of search, assistance and booking management.

The rental contract is entered into directly between the Customer and the Third-Party Supplier (Owner or Charter Company).

3. Nature of the service

The service does not constitute a package tour under Italian Legislative Decree 62/2018. AZWEBITALIA S.a.s facilitates the connection between supply and demand without assuming any responsibility relating to the performance of the sailing service.

4. Booking procedure

Boat search

The Customer sends a quote request through the website. Technical and commercial information is provided by the Owner under their own responsibility.

Receiving the quote

The Customer receives one or more personalized quotes and may request temporary options on the boat.

Booking confirmation

The booking is confirmed only after the contract with the Third-Party Supplier is signed and the required deposit is paid.

Boarding voucher

Once the balance has been paid, the voucher with all the operational details of the rental will be sent.

5. Rental contract

The rental contract is entered into exclusively between the Customer and the Owning Company. AZWEBITALIA S.a.s remains unrelated to the contractual relationship concerning the use of the boat.

6. Limitations of liability

AZWEBITALIA S.a.s is not liable for direct or indirect damages arising from the use of the boat, in relation to:

  • the condition and maintenance of the boat;
  • services provided by the Owner;
  • weather conditions;
  • delays or cancellations;
  • overbooking;
  • operational decisions made by the skipper;
  • events beyond the intermediary's control.

7. Skipper and crew

AZWEBITALIA S.a.s is not the employer of onboard personnel. Skippers, hostesses and onboard staff are independent, self-employed professionals. Their engagement and the entire contractual relationship relating to the services performed on board take place exclusively between the Customer and the professional engaged. AZWEBITALIA S.a.s and the Owning Company act solely as intermediaries in the initial contact phase and do not in any way assume the role of employer, principal or party responsible for the professional relationship established between the parties. Any responsibility relating to the performance, conduct and work of the crew remains exclusively within the direct relationship between the Customer and the professional.

8. Complaints

Any complaints must be reported immediately to the charter base during the rental.

AZWEBITALIA S.a.s will assist the Customer in communicating with the Third-Party Supplier without assuming any obligation for direct reimbursement.

9. Force majeure

AZWEBITALIA S.a.s cannot be held liable for events beyond its control, including but not limited to:

  • adverse weather conditions;
  • government restrictions;
  • pandemics;
  • port closures;
  • natural events;
  • unforeseeable technical breakdowns.

10. Insurance

The Customer is responsible for arranging any personal insurance, such as:

  • trip cancellation;
  • security deposit coverage;
  • medical assistance;
  • personal liability.

11. Privacy

The Customer authorizes AZWEBITALIA S.a.s to transmit to the Third-Party Supplier the data necessary to manage the booking, in accordance with EU Regulation 2016/679 (GDPR).

12. Applicable law and jurisdiction

These Terms and Conditions are governed by Italian law.

Any dispute shall be subject to the exclusive jurisdiction of the Court of Varese, unless otherwise required by mandatory law.
